Businessman faces state tax charges

— A businessman was arrested Thursday on tax charges filed by the state Department of Revenue.

Russell E. Brummitt, Jr., 48, of 14205 Cross Creek Drive in Raleigh was charged with two counts of income-tax evasion, three counts of failure to file individual income taxes and three counts of failure to withhold income taxes.

Arrest warrants allege that Brummitt, as owner of Ora Designers/Fine Jewelers, transferred the assets of the corporation to a trust, Ora Jewelers, in an attempt to evade or defeat the state's individual income tax.

Brummitt was also charged with willfully failing to file his 2001, 2002 and 2003 state individual income-tax returns and with aiding and abetting Ora Jewelers to willfully fail to withhold state income tax from its workers from July 1, 2003, to Dec. 31, 2005.

Brummitt was arrested at Ora Jewelers, 6301-A Falls of the Neuse Road, and taken before a Wake County magistrate. He was placed under a $5,000 secured bond, and a first appearance hearing was scheduled for today.
