Charges against couple dropped

— The Wake County District Attorney's Office dropped all charges last week against a Garner couple involved in an altercation with Wake County detectives outside a Garner restaurant last summer.

Robert Wise had been charged with three counts of assault on a law enforcement officer and one count of resisting a law enforcement officer Aug. 26. His wife, Cynthia, faced a resisting arrest charge.

The three deputies, Katie Broda, Kevin Hinton and Christopher Roth, resigned within a month of the incident. They were indicted this month on a misdemeanor simple assault charge.

Wise said he, his wife and their 11-year-old daughter had gone to Applebee's Neighborhood Bar & Grill in Garner for dinner. The detectives approached the family's Chevrolet Tahoe and asked why it was parked in two spaces. Wise said he was attacked without provocation, suffering cuts and bruises on his head.

Wise and his wife have filed a civil rights lawsuit against the county, the sheriff's office and the former detectives, accusing the officers of "extreme and outrageous behavior."
