Sanitation company contests Garner's choice

— A company that offered to take over garbage-collection duties for the town for the cheapest price is now suing Garner, its mayor, town council members and the company that was awarded the contract despite submitting a higher bid.

Shaw Sanitation Services filed a civil lawsuit Monday in Wake County Superior Court. In the lawsuit, the company says members of the Garner Town Council should have chosen Shaw, not All Star Waste Services, to collect garbage, recycling and yard waste.

On July 21, the town council voted 4-1 to hire All Star, a company based in Johnston County, reaffirming an earlier decision. In doing so, the town will spend $120,000 more of taxpayers' money each year of the three-year contract than it would have spent on Shaw of Wake Forest.

"It's mystifying that they weren't selected," said Brian S. Edlin, an attorney for Shaw.

Garner Town Council members have said they chose All Star because they thought the company would provide a higher level of service.
