County sets closed session set on Jordan basin boundary

DURHAM -- County commissioners will meet in closed session Thursday morning to discuss the Jordan Lake watershed boundary.

Commissioner Becky Heron said Monday that the meeting concerns a protest petition against a rezoning and land-use amendment that effectively moved the boundary. The commissioners approved the changes 3-2 on Oct. 12. The petition, which would have required a 4-1 vote to approve the changes, was ruled invalid by the City/County Planning Department.

The Southern Environmental Law Center, which filed the petition, has since claimed the planning decision was in error. The planning department reviewed the claim and sent a report to county officials Friday. Its contents have not been made public.

A county release said the meeting is "to consult with an attorney" and discuss Southern Durham Development Inc.'s lawsuit against the county over submitting the zoning and land-use changes to public review.

Southern Durham Development seeks to build a subdivision on land which the commissioners' vote removed from the lake's critical watershed.
