Clayton driver, 95, charged in fatal accident

— Police on Tuesday filed charges against an elderly man who lost control of his pickup truck in a Walmart parking lot this month, killing one woman and injuring two others.

Smithfield police charged Benjamin Moye, 95, of 1168 McLemore Road in Clayton with one count of misdemeanor death by vehicle.

The accident occurred Oct. 1 in the Walmart parking lot at 1299 Brightleaf Blvd. in Smithfield.

Witnesses told police that three women - Lois Shannon, 73, Debra Holmes, 53, and Jeanna Holley, 35 - were walking toward their car when they were struck by a Chevrolet Silverado driven by Moye.

Emergency workers transported all three women to Johnston Medical Center in Smithfield, where Shannon died of her injuries.

Moye is scheduled to make his first appearance in Smithfield District Court on Nov. 8, authorities reported.
