The incident happened about 7:30 p.m. Friday when Deputy Ricky Spivey stopped a vehicle driven Michael Joseph Morgan near Morgan's home at 1129 Wimberly Road in Apex. During the traffic stop, Morgan drove off, dragging Spivey from his vehicle.

Deputy Casey Miller, who had arrived at the scene, fired at the vehicle and Morgan was struck by two bullets, the department said. Morgan was taken to Durham Hospital with non-life-threatening injuries. Spivey sustained minor injuries.

A charge is pending against Morgan of felony assault with a deadly weapon on a government official.
