Man was in yard, gun in truck when deputies arrived at Wake Forest shooting

— Sheriff's deputies who rushed to a call of a fatal shooting on Saturday evening found 89-year-old Calvin Anderson Ray Sr. standing in the front yard of his 101 Jordan Road home and a shotgun on the driver's side seat of his white Ford pickup, according to information in a search warrant issued later that night for the scene.

They also found Jeffery Baylon Mitchell, 47, who lived nearby at 27 Spring Lane, dead on the porch of the house with a pool of blood beneath his torso.

“He was breaking into my home. I had to shoot him,” investigators quoted Ray as saying.

Their request to magistrates for the search warrant also said they found part of the front-door molding broken and lying on the threshold of the half-open doorway.

Among the items seized during the search was a “clipped up note” found in a kitchen garbage bin, but the warrant returned to the Wake County Court Clerk’s office on Monday gives no indication of its contents.

The sheriff’s office said Monday that investigators had met with staff from the district attorney’s office, and prosecutors had decided that “at this time there will be no criminal charges against Mr. Ray.”

The sheriff’s office also said it has not closed the case, however.

Ray owns the mobile home park where Mitchell lived, county records show.

In the warrant application, deputies said dispatchers had been told that a “suspect was attempting to leave the residence in a white truck with a shotgun in hand.”

Authorities have not said how they were notified about the shooting.
