Merck to pay N.C., other states $58 million over Vioxx

Merck will pay $1.8 million to North Carolina as part of a $58 million settlement related to marketing of the drug maker's Vioxx pain treatment.

In addition to the payment, Merck must make changes in the way it market and advertises drugs.

The settlement, announced today, is the largest amount of money ever paid by a prescription drug company to settle a multi-state case, according to the N.C. Attorney General's office. It ends an investigation that 30 states began three years ago into Merck's advertising of the pain medicine Vioxx.

Today's judgment requires Merck to submit all TV drug ads to the Food and Drug Administration for review.

Vioxx was taken off the market in 2004 after research showed it doubled the risk of heart attacks and strokes.
