Salix sues rival over generic medicine

Morrisville -- Salix Pharmaceuticals, a Morrisville company specializing in gastrointestinal medicines, has filed a lawsuit to prevent a competitor from bringing to market a cheaper, generic version of its bowel cleanser Osmoprep.

New Jersey-based Novel Laboratories has asked the Food and Drug Administration for approval to sell generic Osmoprep. But Salix sued Novel in federal court, claiming its license to protect Osmoprep's patent is valid until May 18, 2013.

Filed Monday in New Jersey, it is the second patent infringement lawsuit Salix has filed against Novel this year. The other one involves Moviprep, another Salix bowel cleanser under pressure from generic competition.
