Judge rejects requests from Duke, Durham in lacrosse suit

WINSTON-SALEM — A federal judge today rejected requests from Duke University and the City of Durham to shut down a Web site that was created to chronicle a lawsuit filed by 38 members of the 2006 Duke lacrosse team.

At the same time, U.S. District Judge James A. Beatty cautioned lawyers about staying within the rules of conduct and making sure that they and anyone acting as their agents limit comments that might prejudice potential jurors.

Lawyers for Duke, the Duke health care system and Durham, as well as lawyers for the 38 plaintiffs, were in Winston-Salem federal court for the first hearing of a lawsuit that is likely to take 18 months or more to get to trial. The plaintiffs include most members of the 2006 Duke lacrosse team, except the three who were charged with sexual assault after a team party in March 2006 and were later exonerated.
