A Durham man who was shot Tuesday died at Duke University Hospital on Thursday, police said.
Officers had found Timothy Devon Fuller, 22, on the 100 block of South Elm Street after responding to a shooting call at 11:16 p.m. Tuesday.
The case is being investigated as a homicide.
It is Durham 40th homicide, but that number includes three cases that have been ruled self-defense and one officer-involved shooting, police spokeswoman Kammie Michael said Friday evening.

There were 42 homicides in 2015, but that number included four cases that were ruled self-defense and one-officer involved case, Michael said.
