Benny Derrick Dimery, accused of involuntary manslaughter in a crash that killed his girlfriend when a train hit his car in Cary on Jan. 2, was served Monday with a warrant charging him and is due to appear in court Feb. 2.
Cary police had said they would arrest Dimery, 24, of Laurinburg when he was released.
Court papers said Dimery’s bail was set at $15,000, and he was released shortly after appearing at the Wake County Detention Center to be booked on the charge.
In the crash, 21-year-old Lauren Webb, died at the scene after the train collided with the car as Dimery tried to get around grossing gates whose arms had come down at Southwest Maynard Road, police said.
