Judge backs hold on new construction

CHAPEL HILL -- An Orange County Superior Court judge has upheld a building moratorium enacted by the Town Council in May.

Judge Michael Morgan denied a request from CAI Group VII LLC to exempt its plans for a 10,000-square-foot orthopedic clinic on Weaver Dairy Road near N.C. 86.

In an order issued Wednesday, Morgan said the moratorium complies with state law and that the town "properly exercised its authority in declining" to exempt CAI's land at the corner of Weaver Dairy Road and Perkins Drive.

The moratorium halts development applications until January 2008 for land near Martin Luther King Jr. Boulevard and Weaver Dairy, Eubanks and Homestead roads. Meanwhile, the town's Northern Area Task Force is crafting new zoning rules for that area.
