CURRENT PRIMARY TIMING

Under current election laws, North Carolina's presidential primaries are always held on the first Tuesday after the first Monday in May. They occur at the same time that state and local primaries are held.

HOW IT COULD BE MOVED

The N.C. General Assembly would make the decision. State Sen. Andrew Brock, a Republican from Davie County, introduced legislation last year to move the presidential primary to the first Tuesday in February in 2008 and every four years after that. The bill was sent to the Senate Judiciary 1 Committee and never came up for a vote.

WILL LEGISLATURE ACT NOW?

The legislature convenes for its "short session" this week, but it is not expected to move forward on legislation changing the date. Short-session rules generally prohibit bills from being considered unless they have already passed either the House or Senate. Those rules could be suspended if enough legislators want to make the change.
