Autopsy awaited on man who died in custody

DURHAM - Police are awaiting autopsy results to determine how a man in their custody died outside a bar late Friday.

Frank Carver Jr., 55, of Independence Avenue in Durham slumped over while in the back of a patrol car. He was being detained after officers responded to a report of a disturbance and found him, armed with a gun, arguing with another man outside PK's Billiards and Sports Bar at 105 Infinity Rd., police said in a news release Monday.

Carver was removed from the patrol car after he slumped and was given CPR, police said.

He then was taken by ambulance to Durham Regional Hospital, where he was pronounced dead at 1:05 a.m. Saturday.

Carver had been arguing with John Jason Johnson, 38, of Wake Forest Highway in Durham, police said. Witnesses told police that Johnson hit Carver in the face, knocking Carver's glasses to the ground. Carver then pulled a gun and fired two shots into the air.

When police arrived, Carver handed over his gun without incident, police said, and he was being questioned when he fell ill.

Johnson was cited on an assault count.

The Durham Police Department's Professional Standards Division is investigating the incident.
