Sheriff says boy, 11, shot with AK-47

YOUNGSVILLE -- A 12-year-old boy accidentally shot a neighbor with an AK-47 assault rifle in Franklin County on Friday afternoon.

Giovann Lopez, 11, was jumping on a trampoline Friday afternoon to celebrate his birthday when he was struck by a bullet. It went through one arm, grazed his chest and hit his other arm, Franklin County sheriff's officials said.

The 12-year-old boy was on the porch next door, playing with the high-powered rifle.

Pablo Mendoza, 31, father of the shooter, was charged with misdemeanor failing to secure a weapon. He was released on a written promise to appear in court.

Giovann was taken to WakeMed Raleigh campus where, according to sheriff's officials, he was being treated for injuries that did not appear to be life-threatening.

Sheriff's officials said Franklin County District Attorney Sam Currin would decide whether to file any charges against the 12-year-old.

Efforts to reach Currin on Saturday were unsuccessful.
