RALEIGH -- The state Highway Patrol has identified a man killed on Interstate 40 on Monday night.

Diego Lopez Chox, 20, was struck and killed by a car as he tried to cross four lanes of traffic after he wrecked his own car, the patrol said.

Chox lived in the 2700 block of Rock Quarry Road, near the scene of the accident.

Just before Chox was killed, he had lost control of his car and hit a guardrail. He then tried to cross the highway in the dark and the rain, and was hit by another car.

Alcohol was likely a factor in the initial wreck, a trooper said, and no charges will be filed against the driver who hit Chox.

Troopers did not know Chox's identity earlier in the week because he was carrying false state ID and Social Security cards, and had no driver's license.
