Tomato grower Ag-Mart has settled a lawsuit brought by the family of a boy born with no arms and no legs.The child's parents worked in Ag-Mart's fields, in North Carolina and in Florida, while his mother was pregnant in 2004. They contend that his birth defects were caused by repeated exposure to pesticides sprayed on crops there.Both sides agreed not to disclose the amount of the settlement, but lawyers for the child said the money was enough to ensure that Carlos Candelario Herrera, now 3, is taken care of for life. Miami lawyer Seth Miles said the settlement would cover his medical costs and provide him an income throughout his adult life.The two sides came to an agreement late Friday. It must be approved by a judge.Leo Bottary, a spokesman for Florida-based Ag-Mart, said he could not comment on the settlement. Ag-Mart grows tomatoes in Brunswick County, as well as in Florida, New Jersey and Mexico. The company sells its tomatoes under the brand names Santa Sweets and Ugly Ripe.Carlos and his parents now live in south Florida.
