A car that had fled from a police officer early Friday morning crashed into a house on East Lenoir Street just east of downtown, killing a man inside the house.
Police say Etgar Edva Bautista-Montoya, 19, was driving in a Jaguar at a high rate of speed on Martin Luther King Jr. Boulevard shortly after midnight when a police officer attempted to stop him. Bautista-Montoya turned north onto State Street, and the police officer, following police department policy, “disengaged from the attempt to conduct the traffic stop,” according to a statement from the police department.
Moments later, the Jaguar went through the stop sign where State Street ends in a T at East Lenoir Street and crashed into the house at 805 East Lenoir.
Anthony Joseph Gaines, 42, was killed. Two children who were also inside the house were taken to WakeMed with minor injuries and later released.
Police say they arrested Bautista-Montoya at the scene of the crash and charged him with DWI and felony death by motor vehicle. They say he and two other teens who were riding in the car were not hospitalized.
Police say additional charges are possible.
