Police say a "Do Not Walk" sign was flashing at a busy North Raleigh intersection over the weekend when a 63-year-old man walked into the path of a Honda.
Emergency workers declared the man, Clarence Edward Hayes of Raleigh, dead at the scene.
Officers at the scene determined that the driver of the Honda, Edwin Arturo Ramos, 24, of Raleigh, had been drinking but was not impaired, according to an accident report made public Tuesday.
The accident report showed Ramos had a blood alcohol content just at the legal limit of .08.

Investigators have not filed charges.
The accident took place at 10:12 p.m. Saturday on Capital Boulevard, near the intersection of Brentwood Road, police reported.
Ramos' 2005 Honda was traveling south on Capital.
Hayes died a short distance from where he lived in the 2800 block of Brentwood Road, according to the accident report.
