Clerk chased robbery suspect out of North Raleigh store and shot him, police say

The Wake County district attorney would not say why a North Raleigh convenience store clerk was charged in the shooting death of a robbery suspect in July.

But investigators believe the clerk, Ramy Ramsis Hanna, chased the armed suspect who had robbed the business of cash.

Hanna and the suspect, Derrick Malik Wiley, got into a physical altercation outside of the store and exchanged gunfire, according to a search warrant made public Tuesday.

A Wake County grand jury on Sept. 24 indicted Hanna on charges of voluntary manslaughter.

District Attorney Lorrin Freeman would not say specifically what prompted her office to present the case to the grand jury.

“But as a general rule, the law allows an individual only to use that force which is necessary to end an immediate threat,” Freeman said. “In those situations where an individual’s actions exceed that lawful authority, he or she is subject to prosecution.”

Three others were charged in connection with the robbery, police said Tuesday. They are:

Marquee Landell Yarborough, 27, of Zebulon

Kristopher Lowery, 26, of Greensboro

Maya Parker, 25, of Zebulon

All were charged with one felony count each of robbery with a dangerous weapon and conspiracy to commit robbery with a dangerous weapon. Lowery, who was arrested in Wilkesboro, was also charged with possession of a firearm by a felon, according to police.

It was about 10 p.m. on July 14 when Wiley, 21, of Raleigh walked into the Mini Mart at 5508 Old Wake Forest Road brandishing a black semi-automatic handgun, according to a search warrant.

Raleigh police investigator M.M. Harmon wrote in the search warrant that Wiley pointed the handgun at a clerk behind the counter and demanded money from the cash register.

The clerk, later identified as Hanna, handed over an undisclosed amount of money to Wiley, who took the cash and ran from the store. Hanna followed Wiley out of the store and ordered him to stop, Harmon reported.

Several shots were fired.

Police were alerted at roughly 10:20 p.m. about an injured person lying in the road in the 4200 block of Waterbury Lane. Police found Wiley, who had a gunshot wound to his leg.

Weeks later, on Sept. 6, Harmon talked with Wiley’s family members. Wiley’s girlfriend told the detective she had received a message from Wiley’s Facebook account after he was found dead.

Wiley’s girlfriend also told the detective that Wiley had communicated with her via Facebook while traveling from Greensboro to Raleigh before he was shot. Wiley told her he was concerned about traveling to Raleigh to commit the robbery with Lowery, who he did not trust.

Investigators say Wiley’s phone was not in his possession when they found his body. Yarborough told police that Lowery took Wiley’s phone after he was wounded and left him in the road.

Harmon, the police detective, obtained the search warrant to review Wiley’s Facebook account in an effort to find his phone and to identify others who may have been involved in the botched robbery.

Yarborough and Parker are both in custody at the Wake County jail. Yarborough is being held under a $125,000 bail, and Parker is being held under a $75,000 bail, a jail spokesman reported Tuesday afternoon.

Hanna was taken into custody at the Wake County jail and was released Sept. 25 after posting a $75,00 bail, the jail spokesman reported.
