Man accused in DWI crash in Garner now charged with killing one of his passengers

A man who allegedly drove while impaired and crashed a car in Garner on March 6 is now accused of killing one of his passengers.

Alberto Urieta-Calixto Jr. was initially charged with driving while impaired and consumption of alcohol under the age of 21 after a single-vehicle rollover on Jones Sausage Road at 10:24 p.m. March 6, the Garner Police Department said in a Wednesday release.

All four occupants of the vehicle suffered injuries and were taken to WakeMed in Raleigh for treatment, police said. Two were in critical condition.

One of the passengers who was in critical condition has since died from their injuries. The two other passengers suffered injuries believed to be less life-threatening.

In addition to the alcohol-related charges, Urieta-Calixto is now charged with felony death by vehicle and felony serious injury by motor vehicle, police said. He was taken into custody without incident Wednesday and will be processed at the Wake County Detention Center.
