Men kick down door, beat man they believed inappropriately touched girl, feds say

A South Dakota man was convicted after officials say he and two others assaulted a man they thought inappropriately touched a girl.

Francis Lee DuBray, 35, was found guilty of first-degree burglary and two counts of assault with a dangerous weapon, according to an Oct. 25 news release from the U.S. Attorney’s Office for the District of South Dakota.

Brian Wallace Taken Alive and Nathaniel B. Griffin both pleaded guilty to charges of first-degree burglary in the case, according to court records.

McClatchy News reached out to attorneys for DuBray, Taken Alive and Griffin on Oct. 28 but did not immediately hear back.

On July 5, 2023, DuBray, Taken Alive and Griffin showed up at a woman’s home in McLaughlin, officials said.

The three went to the home “to assault a man they believed had inappropriately touched a girl,” according to prosecutors.

The woman yelled at them to leave, but one of the men kicked in her front door, officials said.

Taken Alive and Griffin went inside while DuBray stood on the stoop, yelling at the woman for letting the man stay in her house, prosecutors said.

The man was “passed out” when Taken Alive and Griffin began hitting him with a metal bat, prosecutors said. They also kicked him in the face as the woman begged them to stop, officials said.

The man’s nose was broken, and his orbital and sinus bones were shattered, according to officials.

“He still struggles with his vision and headaches today,” prosecutors said.

One of the men also knocked the woman down as they were leaving, prosecutors said.

“As she crawled towards the front door, DuBray kicked her in the face, then fled with his companions,” officials said.

The three men are awaiting sentencing.

McLaughlin is about a 240-mile drive northeast of Rapid City.
