  • Consumers can file claims in North Carolina for the $4 million TreeHouse settlement.
  • Voluntary recall hit private-label waffles sold at Food Lion, Walmart and Aldi.
  • Claimants must file by Dec. 16, 2024 to receive refunds; TreeHouse denies wrongdoing.

North Carolina residents still have time to claim their cut of a multimillion-dollar settlement tied to a frozen waffle recall last year.

TreeHouse Foods, which manufactures private-label products for some of the nation’s largest grocery chains, agreed to pay $4 million to resolve allegations it sold frozen waffles and other breakfast products that were potentially contaminated with listeria, court documents show.

The items were later pulled as part of a voluntary recall at stores including Food Lion, Wegmans, Aldi, Whole Foods, Walmart and others with several locations across North Carolina.

The deadline to file a claim is Tuesday, Dec. 16.

TreeHouse Foods, Inc. has denied any wrongdoing. The Observer reached out to the company for comment Tuesday, Dec. 9 and was awaiting a response.

Here’s what to know as the deadline draws near.

Who’s eligible?

Anyone in the U.S. who bought affected TreeHouse Foods frozen waffle and pancake products “for personal, family or household use” between Oct. 18, 2024 and Sept. 2, 2025 is eligible to file a claim, administrators said.

You can find the full list of covered products at treehousefoods.com.

How do I file a claim?

Claim forms can be submitted online, or printed and mailed to the claim administrator, the settlement website says. Forms can also be requested by email or phone at 1-888-688-4181.

Regardless of how you file, all submissions must be sent or postmarked by Tuesday, Dec. 16.

How much is the refund?

Customers can receive up to $50, though amounts may vary, administrators said.

Those who provide proof of purchase will recoup the full purchase price for each eligible product, inclusive of taxes. Customers without a receipt will be refunded the average price of two eligible products per household.

When will I get paid?

A hearing to finalize the terms of the settlement will take place Friday, Dec. 12. However, administrators advised it’s “always uncertain whether appeals will be filed and, if so, how long it will take to resolve them.”

Refunds are expected to go out after the court approves the settlement, and after any appeals are resolved.
