Man shot at Cary gas station gets charged with assault. Why the shooter didn’t.

A Cary man was arrested Tuesday in his own shooting after police deemed the shooter acted in self-defense.

David Anthony Trombley, 35, is charged with two counts of assault with a deadly weapon with intent to kill in the Jan. 30 incident, court records show.

Police were called to an altercation at the Exxon gas station at 1205 NE Maynard Road at 5:56 a.m., according to a news release.

Trombley was shot in the chest and was taken to the hospital. He was arrested shortly after being discharged, police said.

The shooter, who is not being charged in the incident and who The News & Observer is not naming to protect his privacy, left the gas station before police arrived but “immediately” reported the shooting at the police department, according to the release.

Arrest warrants claim Trombley poured gasoline on the shooter and attacked him with his vehicle.

Trombley is being held in the Wake County Detention Center without bail as part of a state requirement that bond be set by a judge within 48 hours when someone is arrested again while out on bond in a separate case.

At the time of the alleged assault, he was on pretrial release in several Wake County cases, including charges of driving while impaired, resisting a police officer, carrying a concealed weapon and fleeing/eluding arrest with a motor vehicle.
