Woman shoots, kills man in Raleigh road rage incident. Why was no one charged?
No charges will be filed against a woman shot a man fatally outside of a Food Lion in North Raleigh in a road rage incident on Tuesday.
Steven McLamb, 49, was shot shortly after 5 p.m. in the Food Lion parking lot in the Greystone Village Shopping Center on Lead Mine Road, police said previously.
The shooting occurred in an apparent act of self-defense, Wake County District Attorney Lorrin Freeman told The News & Observer.
“A review of the available video evidence and information collected from witnesses during an investigation established that Mr. McLamb engaged in pursuit and was the aggressor in this incident,” Freeman said. “Based on current available evidence and state law, a prosecution was not tenable.”
McLamb is accused of having attempted to open a woman’s car door during the altercation. The woman, who was not identified, fired at him.
Self-defense laws in North Carolina
Freeman said that North Carolina General Statute 14-51.2 allows an individual “to use force to protect themselves when there is a reasonable fear of imminent death or serious bodily harm. “
The law doesn’t permit someone to act as a vigilante but prevents criminal charges against a person acting in self-defense as evidence of the situation showed, she said.
McLamb died in a hospital from injuries sustained in the shooting.
In a news release, Maj. Bryan Harrison of the Raleigh Police Department said they made their decision after consulting with the Wake County District Attorney’s Office.
Just minutes apart, another shooting was reported about 4 miles south of Lead Mine Road.
Police responded to a shooting at the intersection of Glenwood Avenue and Creedmoor Road.
They found woman with a gunshot wound in a separate incident. She was taken to the hospital with non-life threatening injuries.
